1. Preface
The internet service Shaw Brothers Reloaded executes orders by its members, who are labelled customers thereafter, solely on the basis of the following general terms & conditions.
The “general terms and conditions” (GTC) arrange the business partnership between our customers and Shaw Brothers Reloaded in terms of sales of lobby cards, covers and posters via the inernet.
Arrangements diverging from those GTC and special provisions of customers require a written consent by the operator of this site.
If a customer does not agree with our GTC he has to refrain from registration. Persons who have not completed their 18th birthday are forbidden to register and cannot use this service.
2. Corporate Objectives & Services
The company Shaw Brothers Reloaded operates a internet sales business under the URL www.shaw-brothers-reloaded.de. The objective is to sell lobby cards, poster and covers to prospective customers who have registered under a user name and who have acquired a password.
Out of the entire catalogue of products, the customer is free to chose merchandise over the internet.
3. Membership & Conclusion of Contract
After registering successfully and being verified by Shaw Brothers Reloaded, the customer will receive an authentication via e-mail and therewith the contract is deemed to be valid.
4. Customer Details
The customer is solely responsible for any substance of personal data given in the process of registering. The customer affirms that the given data is accurate and truthful – especially in terms of age, personal address of residence and his shipping address.
The customer is required to state his actual address of residence which in some countries is registered at the local registration office. Furthermore he is required to state a valid telephone number.
By registering an account, the customer explicitly confirms that he has surpassed his 18th birthday. The operator is entitled to check personal data via legal papers. The customer assures the operator to provide a copy of papers of identification if need arises.
Fraudulent offences will be met by reporting to authorities of the law and be brought to prosecution before a court of law. Possible claims for compensation are reserved by the operator.
5. Customer Duties
The customer obligates himself to compensate the operator in cases of lawsuits, damages, losses or allowances of all sorts, which could arise due to his registration and participation on this service.
The customer guarantees that his membership code, his client number and his password are not being distributed to third parties.
The customer is required and allowed to use all purchased images, posters, covers, lobby cards and Southern Screen Revisited magazines for personal and non-commercial purposes only. Any infringement of copyrighted materials will be prosecuted and brought before a court of law.
6. Use of Data
The operator needs some personal data of the customer for operating the services. The customer explicitly agrees to the use of data which are necessary to provide and render the services outlined in paraphrase 2.
The customer agrees that his personal data will be stored and evaluated electronically. The operator is entitled to use, process and distribute the data to third parties within the limits earmarked by the licence agreement and under full adherence of the legal data protection and data security acts.
7. Prices & Rates

8. Terms of Payment
The service flat rate and the fare are conform to the tariff model chosen by the customer and payments have to be made in advance.

Should the payment not be settled within a 14-day-opposition period, the operator is entitled to additionally charge Euro 9,50 and to disable the account of the respective customer. The burden of verification of a lesser damage is issued on behalf of the customer.
Due to cost saving, any bills, notes of balances and payment reminders are being sent to the e-mail account of the customer. All letters are made in Word format and can be printed, stored and opened on any PC.
Should a payment reminder not be met with a payment in due time stated therein, the operator will initiate a judicial dunning procedure to receive the outstanding amount. This procedure will cost the customer a substantial additional surcharge and therefore we politely ask that all bills will be met with payments at all times.
In case of a refusal of payment, naturally the customer will be banned from the service.
We would like to inform you that due to German legal regulations according to § 286 BGB a delay of payment occurs if a payment is not made within 30 days of bill reception and/or of the due date.
For all outstanding accounts the operator is entitled to charge default interest of 5% over the standard rate of the European Central Bank if no greater damage has occurred.
9. Right of Withdrawal
The customer is entitled to withdraw from the contract within two weeks of the registration and without giving reasons. The withdrawal has to be sent in written form (i.e. letter, Fax or e-mail). The customer is required to ensure that he is the person to be able to withdraw. Therefore he is required to state his surname, family name, complete address and client number. The time limit for countermanding starts as soon as an agreement/registration is struck and the customer has received notification from the operator in written form. To ensure any withdrawal, the notification of withdrawal has to be sent on time.

The right of withdrawal automatically automatically is terminated once the customer has used the services rendered by Shaw Brothers Reloaded and once he has downloaded products and materials. Any download is a statement of consent according to the contract agreement.
10. Cancellation
The customer is allowed to cancel the contract at any given time. The agreement/contract ends at the respective accounting period.
The cancellation can be made directly on the Shaw Brothers Reloaded shop website at any given time.
Shaw Brothers Reloaded is entitled to terminate a contract/ agreement either by notice or immediately. Reasons are for example the refusal of payments or the fraudulent use of purchased materials and products.
11. Copyright
The customer is required to abide the copyright.
12. National Law
The law of the Federal Republic of Germany is authoritative.
13. Jurisdiction
Place of jurisdiction is Moers, Germany
14. Modifications of GTC
Shaw Brothers Reloaded explicitly states the possibility of modifications of the current GTC and enables the customer to react. Therefore, the customer is entitled to take notice and to refuse any modifications of GTC within a period of four weeks from the day of modification and/or the day of notification of changes onwards. Exceptions are the modifications due to loopholes, infrictions of equivalence or other related content which does not interfere with the legal Transparency Act. Shaw Brothers Reloaded advises the customer in terms of his right of withdrawal and states the respective countermanding period and any legal ramifications due to consent to new modifications in written form via the fixed channels of communications.
15. Printing & Storage
To have the GTC available at all times we advise the customers to download or to print out the entire regulations.
